Website terms: These terms concern use of the CBU Holdings website. Quotations, engineering projects, transport, equipment hire, fabrication and other transactions are subject to the agreement with the identified service provider. Your applicable statutory rights remain protected.
01 About these terms

These Terms of Service set out the conditions for accessing and using the website operated by CBU Holdings (Pty) Ltd (“CBU Holdings”, “we”, “us” or “our”) at cbuholdings.com. They also apply to cbuholdings.co.za where it serves the same website or redirects to it.

Please read these terms before using the website. If you disagree with them, please discontinue use. Their enforceability remains subject to applicable law and any legally required notice or agreement.

These website terms do not replace a separately agreed quotation, project scope, hire agreement, purchase order or other commercial contract.

02 Website purpose and divisions

The website provides general information about CBU Holdings and introduces Engineering, Transport, Plant Hire, Mining, Fabrication and Property.

Some division links direct visitors to the CBU Engineering website. Other division names may be displayed without an active destination. Displaying a division name does not guarantee that a particular service is currently available.

Website content is not, by itself, a quotation, contractual offer, engineering instruction, investment recommendation or guarantee of performance.

Confirm the relevant service provider, availability, scope and commercial terms before placing an order or making a commitment. Group branding or common ownership does not by itself make Holdings a party to another entity's contract or a guarantor of its obligations.

03 Enquiries, quotations and agreements

Sending an enquiry, requesting information or following a division link does not by itself create a service contract or oblige a CBU business to accept work.

Quotations and proposals are subject to their stated scope, validity period and conditions. Where relevant, these may include inspections, access arrangements, material or equipment availability and confirmation of the intended application.

A binding commercial agreement depends on the applicable offer and acceptance, the parties' agreed requirements and the law. Electronic communications may have legal effect; a handwritten signature is not necessarily required for every agreement.

Pricing, payment, delivery, cancellation, hire conditions, warranties and project responsibilities must be established in the relevant commercial agreement, subject to applicable statutory protections.

04 Technical information and operational decisions

General descriptions, photographs and examples illustrate capabilities or activities. They do not establish the suitability of a particular repair, component, vehicle, machine, material or property for your requirements.

Safety-critical and operational decisions must take account of the actual equipment, loading, application, site conditions, applicable standards and competent technical assessment.

Do not rely solely on website content for engineering design, equipment selection, lifting, transport, installation or return-to-service decisions. Obtain an application-specific assessment from the appropriate competent person.

05 Permitted use

You may browse the website and print or save reasonable extracts for lawful informational, evaluation and internal business purposes, retaining relevant ownership notices.

You must not:

  • Attempt unauthorised access to the website, hosting infrastructure or connected systems.
  • Introduce malware, interfere with website operation or deliberately overload communication channels.
  • Impersonate another person or falsely claim an affiliation, appointment or endorsement by CBU.
  • Republish, sell or commercially exploit protected content without permission or another lawful basis.
  • Systematically extract content in a manner that infringes rights, bypasses access controls or disrupts the website.
  • Use the website or its contact channels for unlawful, fraudulent or abusive purposes.

These restrictions do not remove rights or exceptions permitted by applicable law.

06 Intellectual property

Rights in the website's branding, text, layout, photographs, graphics and other protected material belong to CBU Holdings or the relevant rights holders, as applicable.

Access to the website does not transfer ownership or grant a licence to use CBU branding commercially. Uses beyond those permitted by these terms or by law require the relevant rights holder's permission.

Third-party names, trademarks and product references remain the property of their respective owners. Their appearance does not itself imply endorsement, certification or an authorised partnership.

07 Accuracy and website availability

Information may become outdated or contain errors. Confirm specifications, capabilities, availability and other material details directly with the relevant CBU business before relying on them.

We do not promise uninterrupted website access or that every item of general content will be complete, current or suitable for a particular purpose.

We may update, restrict or suspend website functionality for maintenance, security or operational reasons. Changes to website content do not vary an existing commercial agreement unless the parties lawfully agree.

08 Communications and submitted information

Information you send to us should be accurate and relevant to your enquiry. You must have authority to disclose material belonging to another person or organisation.

Send only the information reasonably needed to begin an enquiry. For confidential drawings, sensitive project documentation or other restricted information, first agree an appropriate communication method with us.

Sending material for an enquiry does not transfer its ownership to Holdings or authorise unrelated publication. Any use or disclosure remains subject to the enquiry, applicable law and agreed confidentiality arrangements.

For payment requests or changes to banking details, verify authenticity using a previously trusted contact number before transferring funds.

09 Linked websites

Division links may take you to cbuengineering.co.za . Use of that website is subject to its own terms and privacy notices. Other external websites may also have their own conditions.

A link does not automatically incorporate the destination's terms into these website terms or make Holdings responsible for every statement or service on the destination website.

Confirm the identity of the contracting service provider when making an enquiry or accepting a quotation.

10 Website limitations and statutory rights

General website information is provided for initial information and evaluation. It is not a substitute for a confirmed quotation or professional assessment of your specific requirements.

The website does not itself provide an additional contractual warranty about a project's outcome, service availability or equipment suitability. Actual service obligations and warranties arise from the relevant agreement and applicable law.

Liability arising from website use is determined by applicable law and any enforceable agreement. Nothing in these terms excludes liability for fraud, gross negligence or any liability that cannot lawfully be excluded.

Nothing in these terms waives or restricts non-excludable rights under the Consumer Protection Act, the Electronic Communications and Transactions Act, POPIA or other applicable legislation.

11 Privacy and cookies

Our Privacy Policy & POPIA Notice explains the handling of personal information. Access-to-information procedures are described in our PAIA Manual.

No cookies or visitor-tracking tools are currently active on the Holdings website. Routine technical logs may still be generated by hosting infrastructure. Further information appears in our Cookie Policy.

Use of the website does not itself constitute consent to direct marketing or to processing that legally requires separate consent.

12 Governing law, complaints and changes

These terms are governed by the laws of the Republic of South Africa, subject to any mandatory protections that apply to a particular visitor or transaction.

Please direct website concerns to De Wet Mostert using the contact details below. This does not prevent you from approaching a competent court, regulator, ombud or other legally available dispute-resolution body.

Revised terms will be published on this page with an updated date. Revisions apply prospectively and do not retrospectively change an existing commercial agreement or remove accrued rights. Additional notice or consent will be obtained where required by law.

If a provision is unlawful or unenforceable, it will apply only to the extent legally permitted or be severed where appropriate. The remaining provisions continue to apply to the extent permitted by law.
